when your idea has a worth


You have a commercial idea through which you can generate money and to seek investment or partnership, you discuss the idea with others to become your partner in an upcoming venture. Someone steals your idea and starts his own company on your idea lines and begins to make money. Fine about the feel about being cheated and betrayal but what about if you want to take a legal action and which laws can help you here, Check this out:

1) Copyright Law whenever you create some original work capable of commercial value, your copyright in that work is generated automatically, even if you may not have registered your copyright on it. The laws here are also called intellectual property rights.

2) Evidence Act here you need to prove what you say in court of  law as per the provision of Evidence Act.

3) Contract Act  If you have done something of commercial value and if it was not your intention to do it free (gratuitously), then you are entitled to be compensated for what you may have done.

4) Law of Tort  If  you had shared something in confidence to someone and if there was an implied duty on him of not to leak and not to take advantage of what you told him in confidence, you may be entitled to claim damages if you can prove breach of duty.

The Basic Laws here are 
a) No one has right to put you in any kind of damage unless authorized by law to do so. 
b) Courts are usually inclined to remove injustice unless they are prevented by lack of evidence or by express bar of some provision of law.
