As an activist you must be well aware about the authority of
a District Magistrate or Collector of a district. Authority comes with accountability
so he is accountable for everything in his district having as much power as a
CEO, rather more. Since he is responsible for things happening in his
district you must ensure before filing any case against Union of India, you
have to give notice to him.
As an activist if you come across something wrong, any wrong
doing or lapse in execution in his district, you must bring this in his notice
as earliest possible through, a written regd AD notice or a letter giving
details of wrong complained in details and request him to take action within 60
days as provided in sec. 80 of CPC.
A notice under Sec.80 of CPC should
be sent as under,
- Secretary Home Dept, New Delhi
- Secretary Home Dept, State Secretariat
- The Collector, District Collector office
- Chief of Concerned Department
After 60 days, consider filing an RTI application to know
status of your complaint, you may consider further steps like moving a petition
in High Court or trial court.
